Legal Question in Medical Leave in Virginia
if the business has not been open for 12 months but the hours needed for leave have been met will i still quailify for leave?

No; in order to qualify for FMLA leave the eligible employee must have been employed "for at least 12 months by the employer with respect to whom leave is requested under Section 102;" See SEC 101(2)(A)(i) of the Family and Medical Leave Act.
