Legal Question in Medical Leave in Virginia
Discrimination at work
Since announcing my pregnancy to
my boss, I have heard him comment
that he is upset about me planning
to take my full leave of 12 weeks
after the birth. He has greatly
increased my work load and
continually questions my time away
from work. I provide doctors notices
for prenatal visits and related
illnesses. I have to defend and
provide details dr. notes on why I
can't take medication now that I am
pregnant for previous chronic illness
(those meds are class D and harmful
to my baby). They tried to tell me I
had to file for STD and FMLA now and
that would be deducted from the
time I have after delivery. Our HR
policy states STD and FMLA are due
30 days before due date. I am only 4
months now. I have been told that
because I am pregnant I can not use
my unaccrued PTO due to my
pregnancy. Others in the firm are
allowed to use their unaccrued PTO. I
know they are making things difficult
for me but is that just it? Does any of
this actually cross the line as legally
defined ''discrimination''

Re: Discrimination at work
It might be discrimination, but would not appear to be the kind that is actionable at law.
