Legal Question in Medical Leave in Virginia
an employee's psychiatrist has taken him out of work. Employee wants to return and is getting another doctor to approve his return. The employee has stated he is unable to control his behavior but he wants to return. We, the employer, wants the doctor that took him out of work to return him, no doctor shopping. your thoughts?

Assuming this employee has no contract of employment nor collective
bargaining type of agreement that would bear on this issue, you as the employer
should be able to impose whatever requirements that you wish governing his
return to work-----or decide whether you even want him to returm.
