Legal Question in Medical Leave in Virginia

Family leave act

I have anixety and am unable to work. Hr person said he would send me the forms i recieved and had my dr fill them out but today he called and advised me that i am not eligible because i have only been at the company for less than a year?? Is this correct?

Yes, 1250 hours of employment within a period of one year is a basic requirement for an employee's FMLA eligibility.
