family leave act

my family leave act is up i was not ready to return to work at that time and that was okay w/the company my question is there are no manager positions open now so i will have an hourly position due they have to guarantee my 40 hrs and the same pay or just a job with whatever hrs are available?

No, since you did not return to work when your alloted FMLA leave was up, the company is not obligated to now provide you with a position with pay and benefits the same or similar to what you had before.
