Family Leave Act

My wife works as an adm. asst in a real estate firm. She has been there for 3 years, is she covered by the family leave act? They have less than 50 employees. She is having a hysterectomy next week & we are wondering if she is covered? Thank you very much --

An employer must have at least 50 employees within a 75 mile area of the worksite to be mandated to provide coverage for its employees under the FMLA.
