Legal Question in Medical Leave in Virginia

Family Medical Leave Act does my condition qualify

I have chronic migraines and a heart condition. My doctor filled out paperwork for intermittent FMLA coverage. My HR rep is telling me I am not able to call in an FMLA day on the same day, for example I can't wake up ill on Monday and call to say I am taking the day under FMLA. I requested coverage 2 months ago. I was advised today that I am not being covered. I meet all the basic requirements. I don't know where to turn. Do I have options? My HR rep tried to talk to me about my condition in front of my co workers, I advised I don't want to do talk about my private matters in public and he became angry and advised me that I was not covered. What should my next steps be?

If your company continues to refuse you FMLA leave, you may have to engage the services of an attorney to write them a letter to formally apprise them of their obligations under this particular federal law (and the possible consequences of their failure to comply).
