Legal Question in Medical Leave in Virginia

can you get fired for becoming disabled?

my mom is a realtor in VA. She is the top agent in her Company even though she has been very sick for half the year. She is afraid her boss will now fire her for not meeting a new monthly sales quota because she has been unable to show homes and there for unable to make sales. she is now to the point where she is receiving radiation therapy every day and all she talks about is getting fired and loosing her health care. Can they legally do this to her?

Re: can you get fired for becoming disabled?

Yes, unfortunately they very likely can, unless your mother is working under the protection of an

employment contract which would prohibit her employer from taking adverse actions against her in this paricular situation.
