Legal Question in Medical Leave in Virginia

flma

I have flma it was approved 5/30/07 and i have ibs and used my flma intermittently and was out for month of feb and Mar and i have used all of my 504 hrs. and my aniversary date is 5/30/08. will i be able to get re-certified in 5/30/08 or will i have to wait till 5/30/09?

In order to be eligible for FMLA leave, one must have a record of having worked a minimum of 1250 hours for his or her employer within the 12 months immediately prior to the date for which leave is to commence. The foregoing appears to be applicable whether the leave was intermitently taken or not.
