When does FMLA begin?

I am a teacher in virginia and had a baby over summer break. HR says that my FMLA days start when the baby was born even though my contract work days don't start until Aug 13th. I was only planning on taking 9 weeks off anyway (first quater). But if they start it from the day she was born it won't be enough. Also my baby has down syndrome and will need some heart surgeries in a few months in a different state and I won't be able to travel with her. Can I use the extra weeks then? If I have any.

Yes, you should be entitled to take the full 12 weeks of unpaid FMLA leave under the circumstances which you've described.
