Legal Question in Medical Leave in Virginia
Does FMLA compel my co. to grant time if approved by dr?
My father has several very serious health issues (cancer, possible Alzheimer's diagnosis) he's dealing with currently. As he is unmarried I am condidered his next of kin and have become his primary caregiver. Fortunately his drs. are very supportive of our situation, however, my company has not as I have frequently had to miss work due to surgery, appointments, etc. My question(s) is(are) if my father's doctors are willing to sign the paperwork and if I request the proper papers is my company compelled to grant me the leave?

Your company is required to provide FMLA(Family & Medical Leave Act)leave if they meet the criteria required under the federal statute which are:
A private sector employer must employ 50 or more employees within a radius of 75 miles in 20 or more workweeks in the current or preceding calendar year and must be engaged in commerce or in any industry affecting commerce----in order to be covered by the Act.
All public agencies, regardless of numbers of employees, including state, local, and federal employees, as well as local education agencies such as schools-----are, also, covered by the Act.
