Legal Question in Medical Leave in Virginia

Fmla

I am due to have a surgery in the next month and was told I would be out of work for 6 weeks. I have been 'forwarned' that I may be replaced by the time I get back. What are my rights in VA for this?

Re: Fmla

If you're taking FMLA leave for your surgery, you're entitled to 12 weeks of leave without pay and to be restored to your previous or similar position upon your return to work at the end of these 12 weeks unless you are a supervisory or managerial employee to whom such guarantees are not required to be given.
