Legal Question in Medical Leave in Virginia

FMLA Leave

One of our company Manager's has set her own rules for taking time off do to project restraints. She has requested all employee's provide 1 weeks notice for time off unless it is an emergencey. This is not a P & P company wide rule but a project specific rule. I have one employee claiming it is a violation of FMLA if he can not take time off for sick kids or his own asthma related illnesses. I think these would fall into an ''emergency'' situation and as such should not be an issue. Is there any FMLA violation in such a project specific policy?
