Legal Question in Medical Leave in Virginia
FMLA Leave
When my daughter was born my job approved my FMLA for 6 days per month until she was a year old. They requested 30 days notice if forseeable and 24 hours notice if unforseeable. Recently my daughter was ill and it was an emergency so I called in 2 hours before my shift to take an FMLA day. They are trying to fire me because of the short notice. When reading FMLA regulations, it states if the absence is forseeable 30 days notice and if it not forseeable it states as soon as possible. No where in our policies is FMLA mentioned for me to reflect on nor is our absence policy. What should I do?

Challenge your employer's action in federal court, if necessary, if you're actually terminated for the reason stated.
