Legal Question in Medical Leave in Virginia

FMLA Leave with spouses working for same employer

My question, My husband and I work for a local NOVA county govn't and we are expecting in 2 months. We have been told that WE (together) only allowed for 12 weeks leave. Is this legal?

Yes, see SEC. 102, LEAVE REQUIREMENT. (f)SPOUSES EMPLOYED BY THE SAME EMPLOYER.--Family and Medical Leave Act (FMLA).
