Legal Question in Medical Leave in Virginia

FMLA question about regs

Hi,

My colleague is out on FMLA after a back surgery. She and I teach at a public high school. She was called by an assistant principal and informed that parents were upset because grades were not updated. She then informed my co-worker that she needed to get some papers graded and then grades put in the system. Since she is under FMLA and not getting paid, isn't it illegal for her to be asked/required to do this? I know FMLA covers the job, but is she required to do anything job related while she is on FMLA? Please let me know the law on this.

Re: FMLA question about regs

No, the employee while officially out on unpaid FMLA leave is under no obligation to perform tasks or duties which are associated with the performance of those which are regularly assigned to the position from which she has taken the leave.
