Grandparent that lives in 8 hours away given sole custody

A judge just gave custody of my children, ages 10 and 15 to the paternal grandfather who lives 8 hours away. I am the biological mother and have been the caregiver and custodian of the children up until now. My current husband was charged with physically abusing my 10 year old son regarding an incident that occured while I was at work. CPS investigated and found that I am a ''protective'' parent and that our home is safe. they did not feel it necessary to remove my husband or children from our home or that the children are at risk. My ex-father in law (who lives 8 hours away with a girlfriend)became aware of our circumstances, sued for full custody and was awarded sole custody temporarily. The case is continued in mid June 2003. The children are homesick, depressed and in need of counseling that they are not recieving. My husband has been to parent classes, FIT classes, anger management and counseling. He has letters of reccommendation from program facilatators... Is there any way to have the date of the hearing in June expedited? Any advice on how I can convince the Judge to reunite our family? Any advice will be greatly appreciated.

Virtually all of your questions should be directed to the lawyer representing you in this matter. If you do not or did not have a lawyer

to represent you, this explains in part why the children are where they now are.

You should definitely seek to retain an attorney to represent you. If you cannot afford to hire one, contact your local legal aid society and they may be able to arrange to provide you with one at minimal cost.
