Legal Question in Medical Leave in Virginia

A group with 37 current employees that once had over 50 employees

A group that currently has 37 employees for the past two years once had over 50 employees... is the employer required to provide FMLA leave?

A good question, but the company is probably not

now covered by the Act nor required to implement its provisions.

Addendum to previous answer: I should have added that any FMLA requests that were triggered when

the company was at the required 50+ employee level

and which were approved, must now be permitted to run to their respective completions even though the company may not be currently required to approve any new requests for FMLA leave.
