Re-instatement of intermittent Leave

If an employee has been granted intermittent leave for 1 year, but needs to reapply and have not exhausted all of the time, can he be recertified after the 12 month period is exhausted?

I see nothing in the federal statute governing FMLA leave which would prohibit this reapplication.
