Required to use accured time first

My daughter wants to use FMLA to help me to recover froma a bone marrow implant. He employer sys she must use up all her accured sick and vacation time first befor she can use any FMLA time. Can they force her use her accured time.

Yes, per SEC.102(d)(2)(A) of the Family & Medical Leave Act.
