Legal Question in Medical Leave in Virginia
rolling calendar
I started family medical leave in june 8 of 2006 for a total of 3 weeks. I again took family medical leave in January 2007 for 2 weeks. Do I get my 480 hrs (12 weeks back in June 8 2007. I was given hours and appears they are incorrect. Can you please explain a rolling period.

Re: rolling calendar
Before you would have been eligible to take any FMLA leave, begining on June 8, 2006, you would've had to have been employed by that time at least 12 months with that employer which approved the leave and worked at least 1250 hours. Assuming that you had continued working with that same employer for another year (and had accumulated at least 1250 hours of work time during this period), you should be eligible for an additional possible 12 weeks of FMLA leave by June 6, 2007, assuming that you meet the other eligibility criteria.
