Legal Question in Medical Leave in Virginia

Seperation question

Wife and I have seperated on June 29, 2007. She is moving into her boyfrieds house with our kids. Can I fight that? She claimed originally she would move into her mothers house where kids are familiar with. We agreed to joint custody.

Re: Seperation question

Yes, if there's a court order involving custody, you could petition to amend the order to full custody to you of the children due to the material change in their circumstances which are not likely to inure to their respective best interests.

If there's no court order, then you could also file your petition for full custody based at least in part upon the alleged less than wholesome circumstances of the environment where the children would be required to live which also is not likely to be in their best interests.
