Legal Question in Medical Leave in Virginia

short term disability unpaid?

I work for a retail store in VA, which is based in GA. I am due to have a baby in December, and my boss just mentioned that she might not be able to pay me under the short term disability plan that is outlined in our employee handbook, because it will be too expensive for her to pay my disability and the payroll for my replacement while I am out. Legal? Please help-thanks!

Unless the provision you've mentioned in the employees' handbook constitutes a term of what in fact is an enforceable contract of employment which happens to be outlined in the handbook, the employer would be under no obligation to pay the short term disability benefit.
