Legal Question in Medical Leave in Virginia
I am a teacher and I will be out on FMLA from the end of August-November. Aside from teaching, I am also a coach for the school division. I coach with two other people so the time commitment is not overwhelming and there is no physical strain. Should my employer allow me to keep my coaching job while out on FMLA? There is no statement in the Leave Policy Manual that states that an employee cannot have another job while on leave.

I would think that the particular reason for your
taking FMLA leave could be an important consideration
in evaluating this question, bearing on the credibility of your claims, e.g.,
whether you yourself are ill or pregnant or you're taking it because of a condition covered by a qualifying close family member which your continued
coaching job would not interfere with nor impact in any significant way.
