Legal Question in Medical Leave in Virginia

Being terminated while on FMLA

I was family medical leave for stress related reasons during March 5,2007 - -May 25,2007. I was hospitalized for 1 week and ordered by my physician to take an additional 1 week off work. As stated before my FML was to run out May 25, 2007. I was called into HR on March 10,2007 and informed I was being terminated. Can they legally do this, I worked for a state government agency?

Re: Being terminated while on FMLA

More information is needed in order to respond to this inquiry in an informed manner. State government employers are generally required to abide by the requirements of FMLA. Were you past the probationary period in your state position? Have you initiated a grievance proceeding against the terminating agency? If not, why not?
