Legal Question in Medical Leave in Virginia

Time period

I believe that once qualified that FMLA lasts 13 weeks a year, can a company set the time period of your leave to be less than that? The company I work recently started making employees re-qualify every month for the same condition that had orginally been already qualified. Is that ok for them to do?

The period for FMLA leave is 12 weeks per year.

Regarding the second part of your question as to "requalifying", I simply don't understand it.

An employee either meets the statutory conditions, and, therefore, "qualifies" for FMLA leave, or does not.
