This is apparently a Virginia state law tort question and not a federal tort matter at all. You give no clue as to the age of the child involved, the circumstances which caused him to be in the street in the manner you've described, nor whether there was any parent nearby who should've been exercising due care and control over this child.

The answers to these and any relevant related questions might make a difference as to what remedy you might have (if any)for your damages.
