Legal Question in Civil Litigation in Virginia

Abandoned Personal Property

In December of 2000 a friend of mine left a dress coat at my apartment. She told me several times over a period of at least 7 months that she was going to come over and get it, and she was physically at my apartment at least twice since she left the coat there. In July of 2001, my husband and I moved and in the process, I threw out everything that we didn't need. My friend had moved and I had no contact with her or even knew where she was. Her coat went to Goodwill. Now a year later she is calling my husband's work, (he is in the Navy), and trying to get him in trouble with his superiors and trying to get him sent to Captain's Mast. Can she do this? Isn't there a time limitation for how long she has to come get her property, or am I expected to be responsible for it until she decides to come get it?

Re: Abandoned Personal Property

What superiors of your husband is this woman contacting or attempting to contact? You need

merely to sit down and write out the explanation that you've given here, and, then, in

concert with your husband, decide which superior officer it should be sent or given to, if any.

This woman has no basis in law for asserting a

claim for discarded property under the circumstances that you've described either against you or your husband. Perhaps, she has other motivations.
