auto deal

I purchase a used car from the car dealer and we did the paper work

and they gave me the contract and we drove off.This contract say I put 5000 down and give me the remaining balance due.now the dealer is call because he forgot to collect the 5000 down on 2/12/2008 do I have to pay him if the contract is signed and done.The contract says I paid my down payment and it is not on the payoff amount.payoff show the down payment has brought downthe balance and I can pay the balance and get the title
