Autombile Repair
A few months ago our vehicle was involved in an accident, which was not our fault. It was repaired and paid for by other person's ins. co. It has now been discovered that our van had suffered hidden transmission damage caused by the accident. The ins. adjuster says we must have a used transmission put in. No way. We had a new transmission put in 2 years ago. Our transmission shop told the ins. adj. he would not put in a used one since there had been nothing wrong with the one he put in and he produced a copy of the sales ticket. The adj. said he would have to talk it over with his peers and get back to him. This has been over a week and there has been no response. We need our van back but we don't want to start harassing the adj. for fear he will drag his feet longer. Any suggestions? Thank you in advance for your answer.

You're entitled to a replacement that's reasonably similar to the transmission that was damaged. You're not entitled to a new one, because yours wasn't new. You're entitled to a used one that's two years old, with however many miles it may have on it. Alternatively, you could have your transmission repaired, whichever is cheaper. I would agree that you're not required to take any old used transmission, without some way to document similar wear.
I'd point out that from a different perspective (i.e., nonlegal) that a used, but rebuilt transmission is often better than a new one because the metal has already warped from heat if it was going to and been corrected, and it's more likely to get a closer inspection than a new one.
Perhaps you could get the adjuster to approve the installation of a rebuilt transmission, or else pay for your rental car until someone can find a transmission that's no more than two years old.
