Legal Question in Civil Litigation in Virginia
"B" a former employee I managed was terminated. Later for unrelated reasons I resigned and relocated 3000 miles away. Employee "B" is now suing for wrongful termination.
My former company has contacted me regarding the suit and would like me to be a witness regarding the actions that led up to the termination.
My question is do I need my own counsel to protect myself from possible further litigation? Does the company lawyer represent me ? Can I request counsel as a condition of my participation?
1 Answer from Attorneys
1. Possibly.
2. No, probably not, but you should confirm this with both the
company and its attorney.
3. Yes, of course, as well as reimbursement for your travel/hotel expenses.
Chances are, however, the suit will be dismissed before trial or, if trial
is necessary, the company will prevail. (My opinion.)
