Legal Question in Civil Litigation in Virginia

Bad check from 1999

Some one stole a check from me in 1999 and used it at a resturaunt for $28.00.The resturaunt never contacted and i only found out about it this past year in the mail i got a letter from a place called fraud division check and merchant services 445 hamilton avenue suite,1102 white plains New York 10610,They said i had comitted check fraud and i owe 313.00 by dec 30 or they will file criminal check fraud chargers with my local district attorny.My question is can they do this over 28 dollar check, hasnt the statue of limitaions expired isnt it 5 years in virginia and even in New york isnt it 6 years? do i have anything to worry about.Thank you for your time

Even if the bounced check is no longer actionable due to the statute of limitations, you should still send a written response to this demand denying responsibility for the check and notifying this check collection outfit that you are keeping a careful record of matters and will

not hesitate to pursue your lawful recourse for whatever damages might arise from this incident due to their ill-advised actions.
