Legal Question in Civil Litigation in Virginia
canceling a contract after 'buyers right to cancel' has expired
We got a quote on replacement windows. The quote was for the wrong number of windows. We all verbally agreed to change the # of windows, but the company never sent us a new contract stating the correct # of windows and price, even after we asked numerous times. The 3 day 'buyers right to cancel' expired last night at midnight. We told them this morning we didn't want to use their company anymore b/c all of the confusion and hassle we have encountered. They are now telling us they will sue us for the contract amount since our window of cancelation time is up. I think that it should be null-and-void anyways b/c the contract has the wrong # of windows on it. Not to mention that if we went by our verbal agreement last night about the correct number of windows that it should be, we should still be well within our 3 days of buyers right to cancel b/c we just verbally agreed last night. We have not paid them any money, nor have they given us any products. Can we really be sued over this and owe them money?

Not too likely; a mere quote, and a verbal one at that, normally does not constitute an enforceable contract.
