Legal Question in Civil Litigation in Virginia

My car was damaged by a tow truck driver he will not cut me the check for the estimated damages but will only offer to pay the body shop, is this legal? I would like the check because I don't want to fix the car at this time. I got a low estime to be fair but this is becoming a really annoying. His insurace company call me and told me the same thing.

Yes, quite legal as long as the tow truck operator is willing to pay for the

repair of your vehicle. (He is under no obligation to necessarily "cut you a check"

for the repairs as long as he pays the body shop directly.)
