Legal Question in Civil Litigation in Virginia

used car deal

I purchase a used car from the car dealer and we did the paper work

and they gave me the contract and we drove off.This contract say I put 5000 down and give me the remaining balance due.now the dealer is call because he forgot to collect the 5000 down on 2/12/2008 do I have to pay him if the contract is signed and done ?
