Legal Question in Civil Litigation in Virginia

Condo Ceiling Collalpse

My condo ceiling collapsed due to a roof leak that was the responsibility of the condo association to fix. While condo documents say I am responsible for drywall, if they were negligent in fixing leak and repairing ceiling, can I take them to small claims court to recover my expenses ($800)?

Sure, if the association was negligent in carrying out the repairs to the common area which then caused damage to the inside of your unit, you could certainly sue them. However, first you would want to present the associaton with your formal written claim for damages, properly itemized in order to give them a chance to settle the matter first without having to become unnecessarily involved in litigation.
