Legal Question in Civil Litigation in Virginia

A contractor filed a warrant in debt because I would not pay the remainder of the contract. I am not paying because the contract was not completed and there were damages and cleaning fees incurred by me due to his negligence. I am in Virginia and need to file a counter claim but don't see that exact term on the court documents. Do I just file a warrant in debt against them for what I have paid as the initial part of the contract and the cleaning costs?

You must appear in court for the scheduled hearing at the date and time

specified on the warrant and at that time inform the judge that you

wish to file a counterclaim against the plaintiff. The judge will then inform

you as to the date by which you must file your Answer to the warrant (which may include your counterclaim) and, separately, your Grounds of Defense.

You would be well advised to seek a consultation with a Virginia attorney

with experience in handling cases in the general district court, and, furthermore,

if your adversary is represented by counsel, you also will need to have such

representation to have any chance of prevailing in the matter(s) in controversy (my opinion).
