Legal Question in Civil Litigation in Virginia

Contractor refused to provide me an invoice for work completed

I had an asphalt addition to my driveway, and at the same time, had the contractor seal the ''old'' portion of the driveway. The type of work materials he used should last a minimum of 3 years. However, the contractor didn't properly clean the dirt off from the old driveway (red clay from excavation of the ''new'' driveway which was tracked onto the ''old'' driveway) and simply sprayed sealant over the red clay. The sealant obviously didn't adhere well to clay/dirt, and now the sealant is severely flaking up. The contractor never provided me an invoice. I asked for one verbally, and twice wrote his company in an attempt to receive one. I hoped that an invoice would at least indicate some type of warranty (for lack of a better term). The contractor refuses to contact me, and I can't get past the receptionist. Do I need an invoice to make the case that industry standard (in professional journals and websites) says this product typically lasts 3-7 years, and I have photo proof that his workers simply sprayed sealant over red clay that was stuck to the driveway? Is he required to provide me an invoice by law?

I know of no law requiring such a contractor to provide an invoice. You do not, however, need such

a document to either prepare or file your claim in small claims court. Your written statement as to the facts + the photos will do just fine.
