I co-sighed for my ex-husband to get a car. He stoped making payments, & won't return my phone calls.Can i take him to small claims court to get my name off the contract? Or have the monthly payments garnished from his paycheck? the amount left to pay on the car is approx.$5,300

No, the court will not order your name removed from the contract. You should be able to recover, however, whatever loan payments which you've paid in his behalf to keep the vehicle from being repossessed.
