Evidence in small claims
Customer wrote our business NSF check then stopped payment. Is it possible to introduce evidence person knowingly wrote bad check besides the NSF on check? Can we subpoena customer's bank records for evidnece when we go to court?

Re: Evidence in small claims
Yes, to all of these questions. However, it might not be necessary. A NSF check is presumed
under the law to be made knowingly. You are thinking in the right direction and thinking very carefully. You should check the statutes that specifically govern bad checks.
