Legal Question in Civil Litigation in Virginia

Falling into a manhole

I was walking my dog in my apartment complex when all of a sudden I fell through a loose manhole cover. My legs went in up to my knees, I managed to throw the rest of my body into the grass. I ended up with a pretty bad scrap on on shin along with some pretty nasty bruises on both legs. I talked to the workers in the clubhouse because I did not want a small child or someone else to fall into the manhole. I was then informed that they knew it was loose and that apparently this is where the children in the apartment complex like to play. I asked them to tighten the cover so that it could not happen again. By the end of the night they had placed an orange cone over the man hole. I was just wondering if there was anything that I could do? While I did not break any bones or suffer any severe injury I still feel that I should be entitled to something.

Re: Falling into a manhole

Your compensable damages would include any lost wages attributable to this injury as well as costs for any medical treatments that you might have received as well as any other so-called out of pocket expenditures resulting from the mishap. You might also have a claim for pain and suffering.

The bottom line, however, is that you'll need to put a number on what it's all worth(if anything, and whether it's sufficiently significant to warrant filing suit in small claims court, if necessary).
