Legal Question in Civil Litigation in Virginia
Is it harassment?
My daughter's father constantly calls me. He calls me almost once every hour or so. If I dont pick up my cell phone, he calls me about 20 times in less than half an hour and he'll call my house. He sometimes even leaves me nasty voicemails, where he calls me nasty names and tells me that I better pick up or call him. If I do pick up, he calls me more names and talks down to me. He doesn't even ask about our daughter. He calls just to check up on me and see what I'm doing. Because of this, I'm starting to have anxiety panics and have been diagnosed with depression. We have a 16 month old daughter together and he lives in Texas while I live in Virginia. Even though he lives several states away, I'm still scared of him. He's always been emotionally abusive to me and has even hit me a couple of times when I was pregnant. Is there anything I can do? Is there some kind of report I can file against him?

What about a court order for child support, visitation and custody issues?
If there are no such order(s) to cover these issues, it would appear that it's high time for you to start addressing them during which the conduct of your daughter's father towards you could be made an issue before the court and which as a result may give him an incentive to change his behaviour.

You could consider a protective order or civil action for intentional infliction of emotional distress. I would consult an attorney directly to discuss.
