Legal Question in Civil Litigation in Virginia

Hello,

I purchased a car on eBay that is located in Florida and sent the seller certified bank checks for payment from my local bank in Virginia. The seller will not send me the title, and I have made numerous attempts to get it. I have been unable to go to Fla. and pick-up the car due to my Mother being on life support for several weeks now. The seller assured me via email communcations and phone calls (have all records) that it would be ok to leave it at his house until I can come after it. I asked again last Tuesday 10/26 for the title to me mailed to me via registered mail, but the seller did not send it. Today I found the car listed for sale in the Orlando craigslist (just by accident). It shows that the listing was created on 10/21/2010. The seller sent me a text message today stating that his ex-wife may have sold the car to make him mad (they are currently in process of divorce). I want to know if I can take him to Court for fraud? I don't care if it costs me more than the car is worth. Please advise, Thanks much, Donald.

I assume the checks were cashed. Sounds like you may have a breach of contract claim at a minimum. You should get an attorney IMMEDIATELY. Good luck.
