Legal Question in Civil Litigation in Virginia

Jurisdiction

I am involved in a lawsuit for a warrant in debt in Virginia, arising from a traffic accident in Fairfax County, in which I am the defendant. I would like to countersue the plaintiff and/or their insurance company on grounds of fraud (the damage they say was fixed was not caused by the accident, photo proof), as well as my travel costs from Georgia to Virginia.

Can I file the countersuit in Georgia, as that is where the fraud was visited upon me, or would I have to file in Virginia, since it is arising from the initial incident, the accident?

To be a countersuit, it has to be, by definition filed in the same case as the original suit.

Get a lawyer to review the case and tell you where to file. Ask him/her to also explain why it will rarely constitute "fraud" when the other side makes claims with which you disagree, even if you are correct.
