Loan repayment

I lent my stepdaughter 1200.00 last Sept for a deposit on an apartment. There is nothing in writing as I trusted family. I only have a check made out to her which was deposited directly into her checking account as proof of loan. She in turn used this money to put down the deposit on this apart which was in San Diego, CA. (She nows has moved to Va Beach, Va. She could not aford to live any longer in CA.) It says Loan-apt deposit in the memo field of the check. She has been given one year to repay, either monthly of in full by 9/30/03...her choice. It is now 9/17/03 and she has not paid any of this money back. If the due date passes and she has not sent me a check, what can I do legally since I have nothing in writing from her agreeing to repay this money ? We have had several conversations since spring in which she mentioned that she would have the money by the due date. Please advise and thanks for your time.

You could try to cajole her awhile longer, and if the money owed is still not forthcoming, then your realistic option is to file suit in small claims court or its equivalent.
