Legal Question in Civil Litigation in Virginia

How long does someone have to sue you personally?

I lived in an apartment in 1999. The person I was subleasing from is now suing me, although I never signed a lease.. This is the first I've heard of it since then. Also, if a judgement is placed against me, can he garnish my pay?

Re: How long does someone have to sue you personally?

Generally speaking, suit must be brought within 5 years on a written contract, 3 years on an oral contract.

This is an affirmative defense, based on the statute of limitations, so it requires your participating in the lawsuit in a timely fashion and alleging that the matter is barred by the relevant statute of limitations.

It may be obvious to you that this is a matter best put in the hands of a lawyer.
