Legal Question in Civil Litigation in Virginia

In March 2007 the shooting gallery business beside my retail jewelry store had a fire resulting in smoke and water damage to my business. I turned my file over to an attorney to file a lawsuit and after 3 years he completed nothing. My question is in the state of Virginia has the statue of limitations passed and, if so, can I file a malpractice suit against the attorney?

No, the statute of limitations in Virginia for pursuing a civil claim for the

destruction of property is normally five years from the date of the destruction.

As for the allegedly dilatory lawyer, it would likely be best to start with a demand

letter for the return of your advanced fee payment.
