Legal Question in Civil Litigation in Virginia
I was recently terminated due to alleged photos that were published on Facebook. The evidence was never shown to me and I let them know that I never saw the photo. Also they stated that their forsenic team searched my private photos on my cell phone which was not company owned. Do I have a right to sue? it was coded as Gross Misconducted and now I can not even receive my unemployment.

Of, course, you can sue, which says nothing about the viability of your claims.
Facebook is a public forum which is accessible to virtually anyone. And, whether
the alleged searching of your cell phone photos without further credible evidence would sustain an invasion of privacy/trespasss or similar action would appear problematical at best (in my opinion).
