Legal Question in Civil Litigation in Virginia
Recovering Beyond The Allowable Limit
I am suing the city police dept where I live for the wrongful death of my son. I was told by my attorney that I stand a good chance to win but the city insurance will not pay more that 3 million if awarded damages. My question is if a jury should award more than 3 million is there any way that I can collect the difference that the city's insurance will not cover or I am just stuck with collecting 3 million no matter what the jury awards?

It depends on whether you are suing the dept or an individual officer and for simple or gross negligence. your attorney should know the answers to your questions
Re: Recovering Beyond The Allowable Limit
Perhaps, but if I were you I would concentrate first on actually collecting that first $3 million in damages before troubling yourself about anything else that might be wrestled from that city's tenacious and unavailing grasp.
