Legal Question in Civil Litigation in Virginia
repeated false allegations
my brother has once again been served papers to remove his visitation with his son. this time its drug and alcohol abuse all seven other charges against him have been dismissed in the past. she has a vendetta against him he cant shake. she want him to get drug testing which will only prove he is clean. how can he get her to stop taking him to court for uneeded reasons and costing him time off from work he need to pay her child support. thank you

Re: repeated false allegations
Suggest that he show up for the scheduled hearing to terminate his visitation rights, explain it all to the judge, requesting that the court order one test to confirm that his system is free of drugs, and, (assuming that it is) that after that, that he not be required to appear for his wife's frivolous lawsuits and that if she continues with such that she be subject to court-ordered sanctions.
